Terms & Conditions – Word Mapping Project

These Terms & Conditions (“Terms”) govern your purchase and use of materials from the Word Mapping Project (“we,” “our,” or “us”), operated by Sean Morrisey Consulting LLC. By purchasing or accessing any of our materials, you agree to be bound by these Terms. These Terms supplement our Privacy Policy.

Definitions
“Materials” means all digital products, lessons, activities, matrices, passages, assessments, and any other content sold or provided by the Word Mapping Project.

1. License and Permitted Use

All Materials are licensed, not sold.

Your purchase grants you a limited, non-exclusive, non-transferable, revocable, single-user license for one individual educator.

You may:

  • Use the Materials within one classroom or instructional setting

  • Print and use the Materials with your own students

This license is intended for individual personal and professional educational use only. You may not transfer, assign, or sublicense your license to any other person or entity.

2. Prohibited Use (Important)

You may NOT:

  • Share, copy, or distribute Materials with other teachers, teams, or staff members

  • Upload Materials to shared drives, school servers, LMS platforms, or any system accessible by others

  • Email, post, or distribute Materials online (including websites, social media, or public platforms)

  • Modify, adapt, resell, or redistribute the Materials in any form

  • Use the Materials for any commercial purpose other than your own classroom instruction

If multiple teachers wish to use the Materials, each teacher must purchase their own separate license.

We reserve the right to monitor usage and investigate suspected violations of these Terms.

3. School and District Licensing

If a school or district purchases Materials:

  • A separate license must be purchased for each teacher who will use them

  • Sharing across grade levels, teams, or buildings without proper per-teacher licensing is prohibited

4. Intellectual Property

All Materials are the exclusive intellectual property of the Word Mapping Project and are protected by United States copyright law. Unauthorized use, reproduction, or distribution may result in legal action.

5. Access and Delivery

Access to purchased Materials is provided through Kajabi. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.

6. User Representations

By purchasing or using the Materials, you represent and warrant that:

  • You are at least 18 years of age

  • You are using the Materials for legitimate educational purposes

  • All information you provide is accurate and complete

7. Payments

All payments are processed securely through third-party providers (such as Stripe). You agree to provide accurate and complete billing information.

8. Refund Policy

Because our products are digital and immediately accessible upon purchase, all sales are generally final.

Refunds may be considered only in these limited cases:

  • Duplicate purchases

  • Technical issues that prevent access (after we have attempted to resolve them)

  • Accidental purchases reported within 7 days of purchase

9. Limitation of Liability

The Materials are provided “as is” without any warranties of any kind.

We are not liable for:

  • Indirect, incidental, or consequential damages

  • Misuse or unauthorized distribution of the Materials

  • Any differences in student outcomes or performance

         We do not guarantee any specific educational results.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sean Morrisey Consulting LLC, the Word Mapping Project, and our officers, directors, employees, and agents from any claims, losses, or damages arising out of your violation of these Terms or your misuse of the Materials.

11. Termination

We reserve the right to terminate or restrict your access to the Materials if these Terms are violated. Upon termination, your license ends immediately and you must delete all copies of the Materials.

12. Modifications

We may update these Terms at any time. Continued use of the Materials after any update constitutes your acceptance of the revised Terms.

13. Dispute Resolution

If any dispute arises, we first encourage you to contact us directly at wordmappingproject@gmail.com to resolve it informally.

If we cannot resolve it within 30 days, the dispute will be resolved by binding arbitration in the State of New York under the rules of the American Arbitration Association. You agree to waive any right to participate in a class-action lawsuit.

14. Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.

15. Miscellaneous

If any provision of these Terms is held invalid, the remainder will continue in full force.

These Terms constitute the entire agreement between you and us regarding the Materials.

No waiver of any breach shall be deemed a waiver of any subsequent breach.
